DMCA Copyright Policy

ClipFlip respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act ("DMCA").
1. Copyright Infringement Policy
ClipFlip will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. We reserve the right to:
- Remove or disable access to material that is allegedly infringing
- Terminate accounts of repeat infringers
- Take reasonable steps to expeditiously remove or disable access upon receiving proper notification
2. Filing a DMCA Takedown Notice
If you believe that content available through ClipFlip infringes your copyright, you may submit a takedown notice that includes the following information:
- Your Contact Information:
- Full legal name
- Email address
- Physical address
- Phone number (optional but helpful)
- Identification of the Copyrighted Work:
- A description of the copyrighted work you claim has been infringed
- If multiple works are involved, a representative list
- Copyright registration number (if applicable)
- Identification of the Infringing Material:
- URL(s) or other specific location of the material you claim is infringing
- Sufficient information to allow us to locate the material
- Description of where the material appears on our service
- Statement of Good Faith:
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- Statement of Accuracy:
- A statement under penalty of perjury that the information in your notice is accurate
- A statement that you are the copyright owner or authorized to act on behalf of the copyright owner
- Physical or Electronic Signature:
- Your physical or electronic signature
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Please ensure your claim is valid before submitting.
3. Where to Send DMCA Notices
Please use the email method for faster processing. We typically respond to valid DMCA notices within 24-48 hours.
4. Filing a DMCA Counter-Notice
If you believe that material you posted was wrongfully removed or disabled due to a mistake or misidentification, you may file a counter-notice with the following information:
- Your Contact Information:
- Full legal name
- Email address
- Physical address
- Phone number
- Identification of Material:
- Identification of the material that was removed or disabled
- The location where it appeared before removal
- Statement Under Penalty of Perjury:
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Consent to Jurisdiction:
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which ClipFlip may be found)
- A statement that you will accept service of process from the person who filed the original DMCA notice or their agent
- Physical or Electronic Signature:
- Your physical or electronic signature
What Happens After You File a Counter-Notice:
Upon receiving a valid counter-notice, we will forward it to the party who filed the original takedown notice. If that party does not file a court action within 10-14 business days, we may restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, ClipFlip has adopted a policy of terminating user accounts that are determined to be repeat infringers. We may also, at our sole discretion, limit access to our service and/or terminate the accounts of users who infringe any intellectual property rights of others.
What Constitutes a Repeat Infringer:
- Users who have received two or more valid DMCA takedown notices
- Users who repeatedly upload content for which they do not hold proper rights
- Users who file false or abusive counter-notices
6. User Responsibilities
As a ClipFlip user, you are responsible for:
- Ensuring you have the right to use and process any video content you submit
- Respecting copyright and other intellectual property rights
- Only processing your own Twitch VODs or content you have explicit permission to use
- Understanding that converting someone else's VOD without permission may constitute copyright infringement
Important: Just because a VOD is publicly available on Twitch does not mean you have the right to download, process, or redistribute it. Always obtain permission from the content owner.
7. Safe Harbor Provisions
ClipFlip operates as a service provider under the DMCA's safe harbor provisions (17 U.S.C. § 512). We:
- Do not have actual knowledge of infringing activity
- Do not receive financial benefit directly attributable to infringing activity
- Act expeditiously to remove or disable access to material upon receiving proper notice
- Have designated an agent to receive DMCA notices
- Maintain a policy for terminating repeat infringers
8. Fair Use Consideration
Before filing a DMCA notice, please consider whether the use of copyrighted material constitutes fair use. Fair use is a legal doctrine that permits limited use of copyrighted material without permission for purposes such as:
- Commentary and criticism
- News reporting
- Educational purposes
- Transformative works
Courts consider several factors when determining fair use, including the purpose of use, the nature of the copyrighted work, the amount used, and the effect on the market value of the original work.
9. Twitch Content Considerations
Special considerations for Twitch VOD content:
- Streamer Content: Streamers typically own the copyright to their own broadcasts, but may not own rights to music, games, or other third-party content within those broadcasts
- Music Rights: Most music in Twitch streams is subject to separate copyright and should not be redistributed
- Game Content: Game publishers may have specific policies about use of gameplay footage
- Third-Party Content: Any content within a VOD that belongs to third parties requires separate permission
10. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that:
- Material is infringing, or
- Material was removed or disabled by mistake or misidentification
...may be liable for damages, including costs and attorneys' fees. This applies to both takedown notices and counter-notices.
